    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During an Incident Investigation Closure conducted on July 30, 2025 ; It was determined based on an investigation that watchful oversight was not provided to a 5-year-old child when they sustained an injury when they fell from a monkey bar set on Playground B and the staff was not aware. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During a Complaint Closure conducted on March 16, 2026 ; It was determined based on an investigation that on February 24, 2026, the Staff person did not check to see if an adult was present in classroom D- Middle Back before leaving four 1-year-old children unsupervised . The children were unsupervised for approximately 8-12 minutes. Additionally staff statements revealed that a 1-year-old child was observed alone and unsupervised in the restroom in Building One classroom D-Middle Back.. Exhibit "A"

    During an investigation, it was determined that on July 14, 2025, staff were unaware that a 5-year-old child had fallen from the monkey bars on the playground and sustained an injury to the arm. The staff stated they were positioned, outside, at the classroom door supervising the playground and a child going inside to use the restroom. An enrolled child told the staff member the child had fallen and was injured. The child sustained a broken right arm. The injury required professional medical attention.

    591-1-1-.25(19) · Rule 591-1-1-.25(19) requires that the following areas shall not be used as activity areas for the children: basement area in excess of twenty-five linear feet from a window; rooms with floor levels lower than three (3) feet or more below ground level on all sides; and any area unapproved for use by authorities having jurisdiction.

    During an investigation, it was determined that on July 14, 2025, a 5-year-old child had access and was playing on a playground area that was not licensed. The child and other enrolled children were playing on monkey bars when the injury occurred. There was one staff member with fourteen school-aged children. The staff member was unaware the child had fallen until made aware by another enrolled child.
