    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During a Incident Investigation & Follow Up conducted on August 4, 2025, it was determined based on observation that staff were not seated within an arm’s length of a 1-year-old child in Main 1st Left Infants classroom. In addition, staff were not seated within an arm’s length of two infants in Main 3rd Left during mealtime as required.

    It was determined based on an investigation that on July 23, 2025, at approximately 9:42 a.m., adequate supervision was not provided when a 3-year-old child sustained an injury to the left ear. A child was running in the classroom and fell on the 3-year-old child, causing the child to hit their ear on a toy. Professional medical attention was required. Staff did not provide adequate watchful oversight when they were not positioned in a manner to see and hear the children in care.

    During an investigation, it was determined that on April 5, 2021, a staff person held a three-year-old child by the wrist, resulting in red marks. While holding the wrist and walking the child to time out, the child went limp more than once, and the staff person pulled the child back up. The child did not require professional medical treatment. An enforcement fine was previously issued for this rule violation. This rule violation is no longer appealable.

    During an investigation conducted on April 18, 2022, it was determined that on March 28, 2022, center staff failed to redirect or prevent a two-year-old child from engaging in an activity that was detrimental to their wellbeing and caused an injury. While holding the staff member’s hands, the child leaned back and swung back and forth between the staff member’s legs and around the staff member’s body. The teacher was engaged in a conversation and did not redirect or let the child’s hands go. As a result, professional medical attention was required and the child was treated for Nursemaid’s Elbow.
