    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on May 14, 2025, a 1-year-child was not adequately supervised when the child stuck an unknown foreign object up their nose. There were two staff members caring for nine toddlers when the incident occurred. Children were engaged in free playing while waiting to transition to lunch. Staff stated the foreign object may have been part of a child’s cardboard book the child had been seen playing with. Once staff were aware the object was stuck in the child’s nose, they took the child to the office and tried to remove the object. They could not remove the object, so the child’s parents were notified. The parent was also not able to remove the object, so professional medical attention was required to remove the foreign object from the child’s nose.

    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    It was determined based on an investigation that on October 30, 2023, at approximately 5:45 p.m., a two-year- old child sustained an injury to the right arm after falling off a cement ledge. The staff member stated that they told the child repeatedly to get off the ledge, however, the child refused. The staff member did not physically intervene and remove the child from the cement ledge. The child received professional medical attention.

    During an investigation, it was determined that on October 4, 2023, a five-year-old child was left unattended on the center vehicle for approximately fifteen minutes. Based on staff statements and transportation records, the child fell asleep on the vehicle. A staff member realized that a child was left on the vehicle once the afterschool head count was completed. The staff member ran to the vehicle to retrieve the child once the child’s absence was noticed.

The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.

    During an investigation, it was determined that on October 4, 2023, a five-year-old child was not accounted for during the unloading of the center vehicle. The driver marked the unload section of the transportation log prior to the child disembarking the vehicle. The children exited the vehicle but, staff did not conduct a check before the driver parked the vehicle. After approximately fifteen minutes, staff were made aware that the five-year-old child was left alone in the vehicle.

The vehicle arrived at the center at 2:29 p.m. Logs for the day indicated that a first check of the vehicle was conducted prior to all the children exiting the vehicle. The staff member opened the vehicle door and called the children’s name as they exited the vehicle. The staff member did not conduct a first check due to the driver moving and parking the vehicle. The driver parked the vehicle and immediately exited the vehicle without conducting a check by physically walking through the vehicle and inspecting the seats and underneath the seats. The driver indicated that a first check was completed. At approximately 2:44 p.m. staff were made aware that the five-year-old child had not exited the vehicle and was asleep on the vehicle.
