591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.
During an incident investigation, it was determined that on January 4, 2024, a seven-year-old child sustained a broken clavicle while on the playground. At approximately 5:20 p.m., there were three staff persons with 26 children on the playground. During the incident, two children were “play fighting” in the grass behind the climbing equipment, staff did not observe the incident with the two children to intervene. While the children were “play fighting” one child picked up the other child and slammed them to the ground. The child lay on the ground for approximately five minutes and 22 seconds, unnoticed by staff persons. The child’s parent arrived to pick him up shortly after the incident. The child received professional medical treatment and was diagnosed with a fracture of the left clavicle.

During a Monitoring Visit conducted on October 18, 2022 ; It was determined based on observation that there was an active ant bed on the playground behind the main building towards the back center of the play area. Further, there was exposed concrete with sharp edges immediately outside the exit door from the second classroom on the right side playground and exposed roots. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Licensing Study conducted on April 25, 2023 ; It was determined based on observation that there was an active ant bed on the playground at the exit door to the playground from the two-year-old classroom and there was a hole in the concrete on the first concrete circle that measured 3 and a half inches and sharp edges were present. Further, there were multiple long mushrooms observed on the far right side of the playground next to the fence on the toddler playground and an active ant bed on the right side of the playground by the fence of the playground labeled as the three-year-old playground. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

For example, toddlers shall not be permitted to swing in swings designed for School-age Children. The outdoor equipment shall be free of lead-based paint, sharp corners and shall be regularly maintained in such a way as to be free of rust and splinters that could pose significant safety hazard to the children. All equipment shall be arranged so as not to obstruct supervision of children.
During a Monitoring Visit conducted on October 18, 2022 ; It was determined that there was rust present on the toddler swings on the playground on the left front of the building.

During a Monitoring Visit conducted on October 18, 2022 ; It was determined based on observation that a staff member in the first classroom on the left put a pair of gloves on, wiped multiple children's noses, picked up soft toys, and then placed a snack on the table for a child, and never removed the gloves to wash their hands.

During a Monitoring Visit conducted on October 18, 2022 ; It was determined based on a review of records that eight staff members did not obtain health and safety orientation training within the first 90 days of employment as required.

During a Complaint Investigation by Phone conducted on December 15, 2021 ; It was determined based on investigative findings that on December 7, 2021, the infant teacher did not provide adequate supervision when an infant crawled out of view, behind the changing table. The infant teacher was seated in a rocking chair and did not position herself to ensure that the infant was in view, knowing that the cabinet latch was broken on the changing table. The staff member continued to remain in the rocking chair after the parent entered the room and asked where the infant was. The infant teacher told the parent that the infant was behind the changing table but never attempted to check to see what the infant was doing. The center stated that the infant only had access to bibs that were placed in the cabinet. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

The teacher was unaware that the child's finger was closed in the door until she saw the child's finger during circle time. Medical attention was required. On February 11, 2022, another incident happened in which a two-year-old child was left unattended in the hallway for approximately one minute. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on May 10, 2022 ; It was determined based on investigative findings that a three-year-old child was not properly supervised for less than one minute when the child ran from playground A to playground B. A staff member inside the program observed the unsupervised child as she was changing a diaper in her classroom and kept watch over the child until they could bring them inside the center.
