591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that at 8:47 a.m. on July 14, 2025, adequate supervision was not provided when a 2-year-old child was injured when they were running, fell, and hit a wooden chair in the classroom. At the time of the incident, four 2-year-old children were participating in free play activities. Two staff persons were present in the classroom and were located on the opposite side of the room from the children. The staff persons were engaged in a conversation with each other and were not actively supervising the children when the incident occurred. The 2-year-old child sustained an injury to the left side of the face below the left eye. Professional medical attention was obtained and the child received stitches.

During an investigation, it was determined that on June 15, 2023, at approximately 9:43 a.m., a two-year-old child sustained an injury to the tongue while in the classroom. The two-year-old child was observed by staff to be playing with a toy child and placed the toy car in their mouth. The staff member verbally redirected the child to take the toy car out of their mouth but failed to physically intervene when the child continued to put the toy in their mouth. The two-year-old child fell with the toy car in their mouth sustaining an injury to the tongue. Professional medical attention was required as a result of the injury.
