591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on July 11, 2025, adequate supervision was not provided when a 2- year-old child sustained a crush injury to their finger. The child was inside the 2-year-old classroom and positioned behind the classroom door. A staff member entered the room and closed the door, and at the same time, the child placed their hand between the door and the frame before the door was closed. The staff member walked further into the room, unaware that the child’s hand was stuck. Approximately 10 seconds later, the child pulled their hand from the door and began crying. Another staff member in the classroom asked the child the reason for crying and the child pointed to the door. The child received professional medical attention and was diagnosed with a crush injury to the right pinky finger.

All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on April 4, 2025, there were two staff members and 15 children in the classroom. A 3-year-old child was served a snack which consisted of a fig bar and fruit for snack. The fig bar contained wheat, which was a restricted food item for the child and was a documented allergy. The 3-year-old child consumed one bite of the bar during snack time. After the snack the class transitioned to the playground at 3:30 p.m. and returned into the classroom at approximately 4:00 p.m. The staff person noticed that the 3-year-old had hives on their neck and that the child exhibited signs of an allergic reaction. The child’s parent was contacted, and a staff member administered the child’s Benadryl. The Benadryl did not relieve the symptoms and emergency services were contacted. Staff administered an Epi Pen to the before emergency services arrived. The child was transported to the hospital to receive professional medical treatment and was diagnosed with an allergic reaction due to consuming a restricted food item, wheat. The center staff failed to adhere to the child’s food dietary restriction and served wheat food item to the 3-year-old child. The child received professional medical attention.

During an investigation conducted on June 20, 2023, it was determined that on June 5, 2023, a two-year-old child with a known allergy to wheat experienced an allergic reaction when the child was served graham crackers that had wheat as an ingredient. The child should have been served cauliflower crackers, but the center was out of this food item. The two-year-old child developed hives on their back, torso, neck, their skin turned red, they were scratching and crying after being served graham crackers. Professional medical attention was obtained. 2. 591-1-1-.15(5) requires that the Center provide a menu listing all meals and snacks to be served during the current week except for School-age Centers where the food may be provided by the Parent(s) by agreement between the school-age Center and the Parent(s). Substitutions shall be recorded on the posted menu and menus shall be retained at the Center for six (6) months. During an investigation conducted on June 20, 2023, it was determined that on June 5, 2023, at 2:36 p.m., a two-year-old child with a known allergy to wheat experienced an allergic reaction when the child was served graham crackers as a substitute. The child should have been served cauliflower crackers but the center was out of this food item. The center failed to notify the two-year-old child's parent prior to the child being served a substitution. The two-year-old child developed hives on their back, torso, neck, their skin turned red, they were scratching and crying after being served graham crackers. Professional medical attention was obtained.
