591-1-1-.12(1) · Rule 591-1-1-.12(1) requires that All indoor and outdoor furniture, activity materials, and equipment shall be used in a safe and appropriate manner by each Employee and child in attendance and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

During an investigation, it was determined that on August 25, 2021, at approximately 5:00 p.m., a five-year-old child struggled to get down from the top of the climbing structure. When the child attempted to bring the left leg over towards the inside of the structure, the left foot got caught on the top, and the child fell, landing on the injured arm. A review of the video footage revealed the five-year-old victim child and several other children at various times sitting on top of the climbing structure. The observation concluded that the equipment was being used in a manner that was not safe as well as failed to be used as intended. The injury required professional medical attention.
