591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined on May 2, 2023, at approximately 10:35 a.m., while on the playground, center staff allowed children to engage in rough play when a four-year-old child sustained an injury to their arm. Children were pushing and hitting each other and continued to do so after being told to stop by their teachers. Children climbed to the top of the rock climber and jumped down numerous times. At one point a four-year-old child was pushed by another child and fell from the top of the rock climber and sustained an injury to their arm that required professional medical attention.
