    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an incident investigation closure on May 7, 2026, it was determined that on April 20, 2026, at approximately 10:42 a.m., during transition to the playground area, a 4-year-old child was left alone in the classroom for approximately 40 minutes. There were two staff members present with 13 children, ranging in age from 4 to 5-y-ears old, in the Private Pre-K classroom. During transition, staff conducted name-to-face head count upon reaching the lower level. At approximately 11:16 a.m., another head count was done and there were 12 children present. The staff member realized that one child was missing, and center management was notified. The staff member failed to provide adequate supervision and watchful oversight when a 4-year-old child was left alone for approximately 40 minutes in the classroom and center staff were unaware of the missing child. Additionally, on April 28, 2026, staff failed to provide watchful oversight when 17 children, ages 3 to 4-years- old, were left alone in the Preschool 2 classroom for approximately three minutes. According to staff statements, one staff member asked a staff member who entered the Preschool 2 classroom to watch the classroom so that they could take a break and take out the trash. The staff member agreed. However, both staff members left the classroom. A third staff member was passing through the Preschool 2 classroom and observed that no staff was present in the room. Staff members failed to provide adequate supervision and watchful oversight when 17, 3 and 4-year-old children was left alone for approximately three minutes.

An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    591-1-1-.26(8) · Rule 591-1-1-.26(8) requires that Fall Zones and Surfacing. Climbing and swinging equipment shall have a resilient surface beneath the equipment and the fall zone from such equipment must be adequately $499.00 maintained by the Center to assure continuing resiliency.

    During an investigation, it was determined that on November 29, 2021, a four-year-old child fell from a playground structure and sustained a broken wrist. Center staff confirmed that the resilient surfacing beneath fall zones at the time of the incident measured two inches or less underneath a three-foot tall playground structure. Medical attention was received.
