    During a Complaint Closure conducted on March 7, 2025 ; It was determined based on an investigation that on February 4, 2025, at 7:34 a.m., a six-year-old child was left unsupervised on the bus. There was one staff member and six children on the bus. The staff member did not provide adequate supervision when they left the six-year-old child on the bus for 27 minutes unattended. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an Incident Investigation Closure conducted on February 13, 2026 ; It was determined based on an investigation that on February 3, 2026, a 3-year-old child in the ³Bumblebee I room´was left unsupervised in the classroom for 30-minutes while the class was on the playground. There was one teacher and eleven 3-year-olds in the class at the time of the incident. The parent was notified, but no medical attention was obtained. Exhibit "A"

    During an investigation, it was determined that on February 4, 2025, a six-year-old child was left unattended on the center vehicle for approximately twenty-seven minutes. According to AccuWeather the temperature for that day was 75 degrees. Based on staff statements and transportation records, the child fell asleep on the vehicle. The child was discovered unattended on the vehicle by the staff member who conducted the transportation. The staff member failed to provide adequate supervision and watchful oversight when the staff member was unaware that the six-year-old child was missing and left in the center vehicle for twenty-seven minutes. The center was notified by the elementary school that the six-year-old child was not dropped off to the school by the center. 2.B. 591-1-1-.32(7) requires that children shall be supervised at all times.n During an investigation, it was determined that on February 22, 2024, a one-year-old child sustained a bite to the upper arm, staff could not provide details of how the injury occurred. According to staff statements, there were two staff members present in the classroom; one staff member was on the floor with the children, and the other staff member was changing a child’s diaper. Staff statements further revealed the staff member heard the child screaming and saw the bite on the child's upper arm. Additionally, it was determined that the staff members were not able to respond promptly to the needs and actions of the children being supervised and were unable to respond promptly to provide timely attention to the children’s action and needs. The child received professional medical attention.

The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.

    During an investigation, it was determined that on February 4, 2025, a six-year-old child was not accounted for during the unloading of the vehicle. Rule 591-1-1-.36(7)(d) 2 requires that the second designated Staff person conduct a check of the vehicle immediately upon the completion of the first check of the vehicle. The responsible person shall physically walk through the entire vehicle; visually inspect all seat surfaces, under all seats and in all compartments or recesses in the vehicle's interior; and sign the passenger transportation checklist(s), indicating all of the children have exited the vehicle. There shall be continuous watchful oversight of the vehicle between the first check and second check. During an investigation, it was determined that on February 4, 2025, a second check of the vehicle was not completed when the vehicle returned to the facility. There was one staff member, and six children were present on the vehicle. The six-year-old child did not exit the vehicle when the vehicle arrived at the elementary school. There were no second checks of the vehicle conducted by a second staff person; the center failed to provide a designated staff member to conduct a second check of the bus immediately upon return to the center after morning transportation. Staff failed to physically walk through the bus upon arrival at the center to visually ensure that all children had exited the bus. Staff failed to provide a second signature on the transportation checklist, indicating all the children had exited the bus.
