    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Licensing Study conducted on September 17, 2024 ; It was determined based on observation that staff in classroom E, were not seated with the two-year-old children during lunch. One staff member was standing and serving the children. The other two staff members were involved in other tasks. No one was observed to be within arm's length of the children. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an Incident Investigation Closure conducted on June 10, 2025 ; It was determined based on an investigation that on April 16, 2025, at 10 a.m. a 2-year-old child was injured while in care. The staff did not provide adequate supervision when they were not alert or positioned to hear and see the children at all times and respond promptly to the needs and actions of the children being supervised when a staff member opened a closet door, a 2-year-old child placed their hand in the door jamb of closet door, and the door closed on the child¶s hand. The 2-year-old child was treated at a medical facility and was diagnosed with a broken middle finger of the right hand. Professional medical attention was required. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an investigation, it was determined that on April 16, 2025, at approximately 10 a.m., a 2-year-old child was injured when their hand was closed in the jamb of a closet door. A staff member went into the closet, removed a handbag, and closed the door. The child’s hand was in the door jamb when the door closed. Additional staff in the room were positioned at the changing table and on the carpet with children. The 2-year-old child cried out, alerting the staff member of the injury. The child’s hand was removed from the door jamb with assistance from administrators after the classroom teachers were unable to remove the child’s hand from the door. Staff failed to actively supervise and provide watchful oversight to the children while in the classroom, which resulted in the 2-year-old child being injured. The child required professional medical attention and sustained a finger injury as a result of the incident.

    591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

    During an investigation, it was determined that on April 16, 2025, at approximately 10 a.m., a 2-year-old child injured a finger while at the center. Statements revealed that at approximately 2:34 p.m., the 2-year-old child's parent picked up the child at the center. The child had been involved in an incident that required professional medical attention. The Department determined the center failed to notify the parent that the 2-year-old child was injured, crying and in discomfort throughout the day, and remained at the center. The child’s parent was not notified immediately as required.
