    591-1-1-.12(1) · Rule 591-1-1-.12(1) requires all indoor and outdoor furniture, activity materials, and equipment shall be used in a safe and appropriate manner by each Employee and child in attendance and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

    During an investigation, it was determined that on July 11, 2025, staff allowed a 3-year-old child to play with and jump from a foam block that was intended for children 7 years of age and older. A staff member verbally redirected the child to instruct them not to jump but did not physically remove the child from standing on the foam block. The child jumped from the foam block, fell on their ankle, and sustained a fractured leg that required professional medical attention.
