591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm's length away from children thirty- six (36) months of age and younger.
During a Complaint Closure conducted on August 10, 2024; It was determined based on an investigation found that on May 3, 2024, at around 9:40 a.m., a three-year-old child left the classroom and exited the childcare center, eventually reaching a busy intersection down the street. Staff were unaware of the child’s absence, and the child was unsupervised for approximately four minutes. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an investigation, it was determined that on May 3, 2024, a three-year-old child was not adequately supervised when they exited the center unnoticed by center staff. At approximately 9:40 a.m., there were two staff members and 27 three, four, and five-year-old children in the classroom. The three-year-old child exited the classroom, walked down the hallway and out the front door, then walked through the center's parking lot, and toward a busy intersection near the main road, and staff members were unaware of the child leaving the classroom. Three adults in their separate vehicles observed the three-year-old child walking down the street towards a busy intersection. One of the parents used their car to block the child from going any further into the main road. A parent got out of their vehicle to retrieve the child from going into the road. The child’s parents were notified by staff. The staff walked to the road to retrieve the child. The child was unsupervised for approximately four minutes. The three-year-old child was approximately 272 feet away from the facility.
