591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an Incident Investigation Closure conducted on September 15, 2021 ; It was determined during an investigation that on September 2, 2021, there was a lack of watchful oversight when a two-year-old child was missing for an undetermined amount of time. The child left their assigned classroom and exited through two entry doors where they were later found near the center's parking lot. Staff were unaware of how the child exited the building. There were no injuries reported. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on April 26, 2022 ; It was determined during an investigation that on January 20, 2022, center staff failed to provide watchful oversight when a two-year-old child sustained a large knot and bruise on their forehead. Staff were aware of the injury but explanations were inconsistent on how the injury was sustained. Professional medical treatment was not required or obtained. Exhibit "A"

During an investigation, it was determined that on September 2, 2021, there was a lack of watchful oversight when a two-year-old child was missing for an undetermined amount of time. The child walked out of the classroom door. The infant safety gate installed in the doorway of the classroom had been removed on this date for repair. The two- year-old child exited through the door that led to the lobby and then through the center’s front door. After an undetermined amount of time, the child was found outside near the center’s parking lot. Staff were unaware of when or how the child was able to exit through two entry doors and walk approximately 40 feet from the classroom to the parking lot. There were no injuries reported.
