591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervisions must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
On May 13, 2025, at 12:05 p.m., a 3-year-old child sustained a dental injury after being accidentally struck by another child during a classroom music and movement activity. Three teachers and 16 children were present. While the children were active on the carpet, the teachers were grouped in a corner, talking, eating, and one using a phone to change music. They were not strategically positioned to monitor or respond to the children’s actions. During the activity, two children were roughhousing, and one was thrown into the injured child, causing the child to hit their mouth on the other’s head. Both children cried out in pain, prompting the teachers to respond and notify administrative staff. The parent was informed electronically and provided an incident report. After nap, the child complained of tooth pain and was still bleeding. The parent was contacted again and picked up and the child was taken to obtain professional medical attention.

It was determined based on an investigation, that staff failed to provide watchful oversight when on August 23, 2023, at approximately 4:25 p.m., a two-year-old child sustained an injury to the left arm and staff were unaware of how the injury occurred. The child received professional medical attention.
