591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on December 6, 2024, a three-year-old child climbed onto playground equipment, fell and sustained a serious nose injury. At the time of the incident there were five staff members, and 34 children present on the playground. At approximately 10:28 a.m., video footage showed children playing on riding toys and a climbing structure. The three-year-old child climbed up the slide on the purple play structure. While at the top of the climbing unit, the child straddled the edge of the slide, then lay on their stomach holding on with their arm extended. The child then climbed up the slide to the platform and stumbled, hitting their face on the opening of the tunnel. After the incident occurred, the child laid inside the tunnel with their feet hanging out unnoticed by staff persons for approximately two minutes. The child then stood on the platform facing two of the staff persons, the staff persons observed blood on the child’s face and ran to assist the child. The staff failed to provide adequate supervision and watchful oversight of the children when on the playground. The center staff did not notice the child’s activity while on the climbing unit and did not redirect the child’s use of the outdoor climbing equipment.

During an investigation, it was determined that on November 21, 2024, a two to three-year-old child was found alone on the playground by a passerby. According to staff statements, it was revealed that the director and center staff were not aware of a child being left alone on the playground. According to video footage, it revealed that a three-year-old child tucked beside the sand table and hid before the class went inside. The staff member was observed walking around the playground to gather the children then go inside the classroom. Video footage also showed the class was inside for two minutes and 39 seconds, the three-year- old child was observed to get up from a seated position and walk toward the playground fence. The staff failed to provide adequate supervision and watchful oversight of the children while the classroom was on the playground. After the class had been inside for three minutes and 24 seconds, a staff member was observed to open the classroom door and bring the child inside the classroom.

During a complaint investigation and licensing study, it was determined that on February 6, 2024, it was determined that during lunch in the two-year-old classroom, one staff member was helping children wash hands and the other staff member was walking on the opposite side of the classroom and was not seated within arm’s length of the table during the lunch meal as required. The staff failed to provide adequate supervision and watchful oversight of the children during lunchtime.

Center Staff shall place an infant to sleep on the infant¶s back in a crib unless the Center has been provided a physician¶s written statement authorizing another sleep position for that particular infant that includes how the infant shall be placed to sleep and a time frame that the instructions are to be followed. When an infant can easily turn over from back to front and back again, Staff shall continue to put the infant to sleep initially on the infant¶s back but allow the infant to roll over into his or her preferred position and not re-position the infant. Sleepers, sleep sacks and wearable blankets that fit according to the commercial manufacturer¶s guidelines and will not slide up around the infant¶s face may be used when necessary for the comfort of the sleeping infant. Swaddling shall not be used unless the Center has been provided a physician¶s written statement authorizing its use for a particular infant that includes instructions and a time frame for swaddling the infant. Center Staff shall not place objects or allow objects to be placed in or on the crib with an infant such as but not limited to toys, pillows, quilts, comforters, bumper pads, sheepskins, stuffed toys, or other soft items and shall not attach objects or allow objects to be attached to a crib with a sleeping infant, such as, but not limited to, crib gyms, toys, mirrors and mobiles.
During a Complaint Investigation & Monitoring Visit conducted on July 25, 2023 ; It was determined based on observation that in classroom Third Right, an eleven-month-old child was observed asleep in a crib with stuffed animal with small blanket attached under the child's face that posed a safe sleep hazard.

During a Complaint Investigation & Licensing Study conducted on April 28, 2021 ; It was determined based on observation that the following hazards were observed: -In the two-year-old classroom, a large container of sanitizing wipes was observed to be open and stored on a low shelf on the back right side of the classroom accessible to the children in care. -In the three-year-old classroom, a bottle of Pine-Sol and bleach were observed in a unlocked cabinet under the sink accessible to the children in care. -In Pre-K Two, a plunger was observed to be store in the bathroom on the left accessible to the children in care.

During a Licensing Study conducted on April 25, 2022 ; It was determined based on observation that the following indoor storage hazards were observed: -In classroom 1st left, two bottles of hand sanitizer were stored on a low shelf accessible to children. -In classroom 1st right, two large black garbage bags were stored in the classroom accessible to children. Additionally, a staff member's purse was stored accessible to children and had a bottle of hand sanitizer hanging from it. -In classroom 2nd left, a staff member's purse was stored on a low shelf accessible to children. -In classroom 3rd left, a staff purse was stored on a low table accessible to children. During a Complaint Investigation & Licensing Study conducted on April 28, 2021 ; It was determined based on observation that the following instances of the classrooms being over ratio were observed: -When the consultant arrived, 17 three-year-old children were observed to be in the three-year-old classroom with one staff member where two staff members were required. -One staff member was observed to step out of the two-year-old classroom for approximately three minutes leaving one staff member with 16 two-year-old children where two staff members were required. -While on the playground, one staff member was observed to have 16 two-year-old children where two staff members were required. -While on the playground, one staff member was observed to have 11 one-year-old children where two staff members were required.
