During an investigation, it was determined that on October 31, 2023, a one-year-old child was picked up in a manner that could cause injury. A staff member in the classroom went to help a one-year-old child put their coat on. The staff member picked the child up by one arm and the child immediately showed signs of distress. The staff member informed the director that the child was showing signs of distress. The director contacted the parent who took the one-year-old child to seek professional medical attention. As a result, the child was diagnosed as having a dislocated elbow.

Staff failed to redirect a child that pulled a bean bag in front of the bathroom door while children were walking in and out of the bathroom. The child placed their feet on the door and kicked the door closed. A child exiting the bathroom had their finger caught in the door and received professional medical attention.

Rule 591-1-1-.32 (7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers, and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training and provide timely attention to the children's actions and needs. It was determined based on an investigation that on October 31, 2022 at approximately 3:37 p.m., center staff failed to provide adequate supervision and watchful oversight when a one-year-old child's finger was closed in the bathroom door in the classroom. It was observed on video footage taken at the time of the incident that one staff member was inside the restroom changing diapers and the second staff member was picking up toys when one child pulled a bean bag in front of the bathroom door, sat in it and started kicking the door closed as children walked in and out of the bathroom. Staff failed to redirect the child when their feet was on the door or when they kicked the door closed. A one-year-old child’s finger was closed in the bathroom door and received professional medical attention.
