591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on September 22, 2025, adequate supervision was not provided when a 2-year-old child was left unattended on the playground for approximately 30 minutes. The 2-year-old child’s class left the playground at approximately 5:10 p.m. At approximately 5:36 p.m., the child’s parent arrived for pick up and found that the child was not in their classroom. The parent then spoke with an administrator in the hallway. During that time, the child’s teacher appeared in the hallway with the child. The teacher stated that the child had been left on the playground.

During an investigation, it was determined that on July 20, 2022, an eight-year-old child was sitting in a glider rocker holding an eleven-month-old infant. The eight-year-old child released the eleven-month-old infant, and the infant fell face first onto the floor. The staff member changed the eleven-month-old infant and noticed there was a red bruise on the infant’s forehead. Watchful oversight of the eight-year-old child was not provided to prevent them from holding the eleven-month-old infant and causing the infant to fall onto the floor. Additionally, the staff member placed the eleven-month-old infant on the rug, the infant pulled up on the toy box, fell bumping their face on the toy box. The eleven-month-old infant sustained a head injury that required professional medical treatment.

591-1-1-.32(4) · Rule 591-1-1-.32(4) requires centers with a licensed capacity of 19 or more, children under three (3) years of age shall be housed in separate physical areas from older children and cannot be mixed with older children except at the following times and circumstances: (a) During early morning times of arrival and late afternoon times of departure, infants and children younger than three (3) years may be grouped with older children so long as Staff:child ratios and group size are met based upon the age of the youngest child in the group.
