591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on November 18, 2022, at approximately 2:50 p.m., a four-year-old child sustained an injury to the forehead while in the classroom. The child was running in the classroom when the child fell hitting their head on a bookcase causing a laceration. The staff member present first verbally redirected the child but did not physically intervene. Professional medical attention was required.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on July 22, 2022, the center failed to provide watchful oversight when a seven-year-old a child received an injury on their left hand. Center staff allowed a school-aged child to hold the door leading from the outdoor play area and the seven-year-old child's hand got caught in the closing door. The child required medical attention.
