591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on January 9, 2024 ; It was determined on November 17, 2023, at approximately 10:15 AM, staff failed to provide watchful oversight when they did not see when a three-year-old child climbed up a blue slide on the playground and jumped off resulting in a fracture of their left femur. Professional medical attention was received. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Investigation & Monitoring Visit POI Follow Up conducted on May 29, 2024 ; It was determined based on observation that staff # 4 was not alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, when the staff member was laying on a mat located in the back of the classroom, with a blanket covering their face, and on a cell phone during nap time in the three-year-old classroom. Additionally, the consultant made a second visit to the classroom twenty minutes later and the staff member had resumed laying on the mat in the back of the classroom with a blanket covering their face and was on a cell phone. Additionally, the consultant made a third visit to the classroom forty- five minutes later and the staff member had resumed laying on the mat in the back of the classroom with a banket covering their face. During an investigation, it was determined that on November 17, 2023, a three-year-old child was not adequately supervised during outdoor play. The staff members who were responsible for providing watchful oversight to the children did not see when the child fell off the slide and were only alerted that the child was injured when they heard the child crying, and saw the child on the ground. Professional medical attention was obtained.
