591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that when a child requires a modified diet for medical reasons, a written statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child’s Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an incident investigation, it was determined on October 11, 2023, that a two-year-old child was served a food item, fish, which was listed as a prohibited food for the two-year-old child. Staff member A served lunch which consisted of baked parmesan fish, brown rice, orange slices, spinach, and milk. The two-year-old child began to eat the oranges served, when staff member B realized the child was served fish they removed the plate. Staff member A then served the two-year-old child another plate that contained chicken strips instead of fish. During transition from lunch, staff member B noticed that red, circular hives had appeared on the two-year-old's right cheek. Staff member B contacted the front office and advised the administrators that the two-year-old child was having an allergic reaction. The child had a reaction to eating the oranges that were contaminated by the fish and the child sustained hives on their face. The child was diagnosed with an allergic reaction.
