591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

During a Complaint Closure conducted on November 25, 2024 ; It was determined that on April 14, 2024, at approximately 3:30 p.m., a three-year-old child was observed to be wandering in the center's front parking lot alone for approximately one minute without staff knowledge.

During a Complaint Investigation & Monitoring Visit conducted on September 22, 2025 ; It was determined based on observation that center staff in classroom E-Older Infants and G-Three's did not sit within arm's length of children thirty-six (36) months of age and younger during lunch time. During an Incident Investigation Closure conducted on August 22, 2024 ; It was determined, based on investigative findings, that a two-year-old child was left unattended on the playground for approximately 12 minutes and one second on July 25, 2024. Based on video footage, the two-year-old child was left outside unsupervised from 10:29 a.m. to 10:44 a.m., and staff were unaware that the child was missing until returned to the classroom. Center staff were notified, by staff at a local school that was adjacent to the child care center, that the child was unattended on the playground.

591-1-1-.35(2) · Rule 591-1-1-.35(2) requires accessibility of pools. All swimming and wading pools shall be inaccessible to children except during supervised activities.

During an Incident Investigation Closure conducted on August 22, 2024 ; It was determined that while on the playground a two-year-old child had direct access to four kiddie pools that were filled appoximately half way full and contained two to three inches of water. The child was observed to enter one of the kiddie pools and remained in the kiddie pool for approximately one minute. Center staff were notified, by staff at a local school that was adjacent to the child care center, that the child was unattended on the playground.

During an Incident Investigation and Licensing Study conducted on October 17, 2023 ; It was determined based upon observation that three children walked from Classroom H-Four's to the hallway bathroom without an adult present.
