During a Licensing Study conducted on January 2, 2024 ; It was determined based on observation that the following fencing hazards were present on this date: Playground A The entry gate had two protruding bolts that measured over two threads. The wooden fence had two broken slats located on the bottom back right side. The wooden barrier attached to the chain link fence had two protruding screws on the front left side. Playground B The entry gate had rusting and sharp ends on chain link fabric. Playground C The fence on the back right side of the playground had a gap that measured five and a half inches causing a potential entrapment hazard.

During a Licensing Study conducted on July 22, 2024 ; It was determined based on observation that the following fencing hazards were present on this date: Playground A The bottom left front portion of the chain link fence had a gap that measured eight inches high by two feet and four inches wide which caused the fencing to not be fully enclosed. The bottom right front portion of the chain link fence rolled up from the ground, creating a gap that measured six inches. The bottom middle back portion of the wooden fence had two broken wooden slats that caused a potential finger entrapment. Playground B The front right side of the chain link fence had four protruding fence ties with sharp and protruding ends.

The wooden bench under the canopy had splintering wood and two exposed and protruding screws on the back left side. During an investigation, it was determined that on February 10, 2022, at approximately 10:50 a.m. on the playground, watchful oversight was not provided when a four-year-old child unlocked their wheelchair and rolled down the stairs, hitting their head on the steps. At the time of the incident, one staff member locked the wheelchair of the four-year-old child and transitioned the children to the playground helping them collect rocks. The other staff member was standing on the porch next to the victim child observing the children collect rocks. Meanwhile, the four-year-old unlocked their wheelchair and rolled down the stairs, falling and hitting their head on the steps. When the incident occurred, staff were not aware that the four-year-old child unlocked their wheelchair, and therefore, could not prevent the incident. The child required professional medical attention.
