591-1-1-.20(4) · Rule 591-1-1-.20(4) requires the Center to keep medication in a cabinet or container that is locked or otherwise not accessible to the children and to be stored separate from cleaning chemicals, supplies or poisons. Medications requiring refrigeration shall be placed in a leak-proof container in a refrigerator that is not accessible to the children.
During a Complaint Closure conducted on July 24, 2023; It was determined based on an investigation that a two-year-old child was able to access a steroid pill from a staff's jacket pocket and chew on the wrapper until the seal was broken. The child accessed the pill while the staff member was rocking the child and the staff member was unaware that the child had obtained a blister pack of pills from their pocket. Staff did not keep the medication in a locked cabinet or container as required.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor $299.00 activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers, and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined during a complaint investigation conducted on May 10, 2021, that at approximately 4:50 p.m. on April 26, 2021, there was a brief break in watchful oversight when a three-year-old child was observed alone in the front outside area of the center with the front door closed. The three-year-old was alone for less than one minute. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable.

A total of three staff members were terminated from employment at the center because of the incident. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable.

Three staff members were terminated from their positions as a result of such actions. Additionally, it was determined during a complaint closure on June 8, 2021, that on March 26, 2021, a four-year-old child was physically disciplined by a staff member when the staff member twisted and/or thumped the child's ear(s). The staff member was formally reprimanded for their actions. Furthermore, investigative findings revealed that on April 16, 2021, a four-year-old child was grabbed by the ear(s) by a staff member. These actions demonstrated inappropriate discipline. Professional medical attention was not reported as a result of the incident.
