    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During an investigation, it was determined that on March 18, 2025, a staff member pinched the nose of a one-year- old child which resulted in a bruise on the tip of their nose as a form of discipline for hitting another one-year-old child.

    During a Monitoring Visit conducted on May 23, 2024 ; It was determined based upon observation that the following hazards were accessible to children on this date: Bathroom located between Room A and Room B - One plunger and a container of alcohol free hand sanitizer, labeled Keep out of reach of children, was accessible to children under the bathroom sink. Room E -A black plastic grocery bag was accessible to children in a cubby. -Laundry detergent, labeled Keep out of reach of children, was accessible in an unlocked closet.

    During a Complaint Investigation & Monitoring Visit conducted on April 2, 2025 ; It was determined that the following hazards were observed: Building II - Left -There was an unlocked sink cabinet with a toilet bowl brush. Building II - Right -There was a mop bucket in the children's bathroom with an unidentified liquid inside. -There was a pair of adult scissors and a stapler on a table next to the children's bathroom. -There was a pack of Parent's Choice wipes on a desk in the middle of the classroom. -There was a first aid kit on top of the mini refrigerator accessible to children. Building I - D -There was an unlocked sink cabinet in the left bathroom with a plunger. -There was an unlocked sink cabinet in the right bathroom with a toilet bowl brush.

    During a Monitoring Visit conducted on May 23, 2024 ; It was determined based on a review of records that for the afternoon route from Lake Forest Hills Elementary the week of May 13, 2024 to May 18, 2024, the facility did not document the unloading of children with a check mark or other symbol for one child who was transported. It was further determined that the afternoon route from Lamar Milledge for the week of May 13, 2024 to May 18, 2024 the facility did not document the load and unload with a check mark or other symbol for two of seven children transported.

    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on September 22, 2022, a two -year-old child’s pinky finger was shut in the classroom door and required professional medical attention. The class was transitioning to the playground when a child closed the door to the classroom. The staff person was at the front of the line and did not provide watchful oversight to the children at the back of the line to prevent the injury from occurring. The two-year-old child sustained a partial amputation of the pinky finger.
