591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger. AND

It was determined based on an investigation that on December 18, 2023, at approximately 7:45 am, a staff member failed to provide watchful oversight when the driver of the vehicle left two children, ages three and five, unattended on the vehicle for approximately two minutes. Upon arrival at Dean Bridge Head Start to drop off the first student, age three, the driver exited the vehicle to escort the child into the school, leaving the remaining two children in the vehicle unattended.

It was determined based on an investigation that on December 18, 2023, at approximately 7:45 am, the center driver left two students, ages three and five, in a center vehicle unattended while the vehicle was running for approximately two minutes. 591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devi ces to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During a Complaint Closure conducted on February 9, 2024; It was determined based upon investigative findings that Center Staff restrained a seven-year-old child for three minutes. It was further determined that Center Staff restricted a seven-year- old child from using the restroom after the child verbally indicated that they needed to use the restroom a total of fourteen times.

591-1-1-.20(4) · Rule 591-1-1-.20(4) requires the Center to keep medication in a cabinet or container that is locked or otherwise not accessible to the children and to be stored separate from cleaning chemicals, supplies or poisons. Medications requiring refrigeration shall be placed in a leak-proof container in a refrigerator that is not accessible to the children.
During a Monitoring Visit conducted on August 10, 2022 ; It was determined based upon observation that a bottle of Infants Tylenol and a bottle of Little Remedies Gas Relief Drops were on a low shelf in an unlocked cabinet accessible to children in Classroom D.

Classroom C: One pack of Pampers Sensitive baby wipes was in a child¶s book bag. One bottle of Gentle Steps Cornstarch Baby Powder, a plastic trash bag, a plastic grocery bag, and several pairs of gloves were in an unlocked cabinet under the diaper changing table. Classroom D: Two containers of Clorox Disinfecting Wipes, a pack of Tippey Toes baby wipes, and two packs of Pampers Sensitive baby wipes were on a low shelf, in an unlocked cabinet. A container of Vicks Baby Rub Soothing Ointment, a bottle of Little Remedies Sterile Saline Mist, and a tube of Desitin Ointment were in a child¶s book bag. Classroom E: A pack of Parents Choice Fragrance Free baby wipes, a pack of Pampers baby wipes, a pack of Huggies Natural baby wipes, a pack of Baby Soft baby wipes, a pack of Parents Choice cucumber baby wipes, two packs of Hello Bell baby wipes, and a pack of Members Mark baby wipes were on a low shelf in an unlocked cabinet. Two packs of Huggies Natural baby wipes, three packs of Parents Choice baby wipes, one pack of Pampers baby wipes, a container of Clorox Disinfecting wipes, and a bottle of Lysol Disinfectant Spray were in an unlocked cabinet under the diaper changing table.

It was also determined that the blue vinyl triangle mat was torn at the top and side corner, the yellow vinyl triangle mat was torn on two corners, and the blue vinyl chair was torn at the front left corner in Classroom B.
