591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that when a child requires a modified diet for medical reasons, a written statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child’s Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During a self-reported incident, it was determined that on March 6, 2024, a ten-month-old child with a known egg allergy was given French toast that contained eggs. Initially, during the child’s morning drop off by parent, a staff person confirmed with parent as to if the child could eat the French toast and peaches served for breakfast. The child’s parent was not aware there was egg in the French toast served. The center was made aware of the child's egg allergy at the time of the child's enrollment on March 4, 2024, The child's egg allergy was also documented in the child's enrollment packet and feeding plan. The child’s information was added to the center's allergy list, and the list was provided to all staff members and posted inside of each classroom on March 4, 2024. After the child consumed the eggs, a red dot appeared on the child’s forehead. The center notified the child’s parent of the allergic reaction and was informed by the parent to administer the child’s EpiPen, however, the center staff did not administer the EpiPen to the child because there was no medication form on file for the child. The child’s parent dispensed the medication to the child and the child was transported to an emergency room for medical attention. The child was diagnosed with an allergic reaction.
