591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that when a child requires a modified diet for medical reasons, a written statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child's Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on January 21, 2026, at approximately 4:50 p.m., Center Staff did not follow a 1-year-old child's modified diet when the child was served a food item which caused the child to have an allergic reaction. There were four staff members and eleven 1-year-old children and one 11- month-old infant in the classroom during afternoon snack time and crackers were served to the children. The posted allergy list was not checked to determine if there were prohibited ingredients in the crackers that did not meet the 1-year-old child’s modified diet. After leaving the center, the 1-year-old began having an allergic reaction as evidenced by itching, hives and diffulty breathing. The child was taken for immediate professional medical care. Center management was informed of the allergic reaction on the next day and determined that the 1-year-old child was served crackers that contained an ingredient which is a known allergen for the child.

591-1-1-.20(1) · Rule 591-1-1-.20(1) requires that Except for first aid, or as authorized under Georgia law, Personnel shall not dispense prescription or non-prescription medications to a child without specific written authorization from the child's physician or parent. Such authorization will include when applicable, date; full name of the child; name of the medication; prescription number, if any; dosage; the dates to be given; the time of day to be dispensed; and signature of parent.
