591-1-1-.25(13) · Rule 591-1-1-.25(13) requires that indoor storage areas, potentially hazardous equipment, materials and supplies shall be stored in a locked area inaccessible to children. Examples of items to be stored include non- food related products under pressure in aerosol dispensing cans, flammable and corrosive materials, cleaning supplies, poisons, insecticides, office supplies and industrial-sized or commercial buckets with a capacity of three gallons or more or any other similar device with rigid sides which would not tip over if a toddler fell into the container head first.
During an investigation, it was determined that on February 18, 2025, a one-year-old child accessed a glass bottle in a classroom and sustained a cut to their right ring finger. Staff interviews revealed that a staff member left a glass bottle of Kombucha on a toddler table before taking the class outside to the playground. At that time, no children were in the classroom. The parent arrived at approximately 4:30 p.m. to pick up their child. While signing the child out, the child picked up the glass bottle, tripped, and fell. The bottle shattered, resulting in a cut to the child's right ring finger. The one-year-old child received professional medical attention and received four stitches to the right ring finger.

During a licensing study and plan of improvement visit on December 18, 2024, it was determined based on observation in Room A there was a butter knife that was left on a red metal cart, near the sink, and accessible to children in care. The center staff failed to ensure that hazardous items are always inaccessible to children.

During an investigation, it was determined that on May 1, 2024, equipment was not placed so as to minimize the danger of an accident when a monkey bar was installed directly above the wooden border of a sand box. On May 1, 2024, a three-year-old child used a child sized chair to jump off of to reach the monkey bar causing the child to fall and hit their chin on the border of a sand box, resulting in a laceration. The child received professional medical attention, and the laceration was closed with stitches.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs.
