During an investigation, it was determined that on March 31, 2026, at approximately 5:08 p.m., a 2-year-old child sustained an injury to their right middle finger on their right hand caused by an unsecured shelf falling onto their hand. At the time of the incident, one staff member was supervising two children, ages 1 and 2-years-old in the classroom. The staff member was seated on a stool with the 1-year-old child seated directly in front of them and the 2-year-old child was standing near the unsecured shelf. The 2-year-old child pulled on the shelf, which caused the shelf and the child to fall onto the floor. The staff member immediately responded to the child while also seeking additional assistance from center management. First-aid was administered and the parents and emergency medical services were contacted. Professional medical attention was obtained.

During an Incident Investigation Closure conducted on August 15, 2024 ; It was determined that on June 11, 2024, children were not adequately supervised when a one-year-old child sustained a right- hand injury. During music and movement time, a few children left the group area and went to the housekeeping center. As a staff person had their back turned to the children, a therapist in the classroom looked up to see two children pulling on or climbing on a dress up shelf as it tipped over and landed on the child¶s hand. First aid was rendered, and the child¶s parent was notified. The child received professional medical treatment and was diagnosed with a right-hand fracture. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an Incident Investigation Closure conducted on September 16, 2024 ; It was determined based on investigative findings that on August 23, 2024, a one-year-old child was left alone and unsupervised in the facility hallway for approximately two to five minutes. Exhibit "A"

During music and movement time, a few children left the group area and went to the housekeeping center. Two children pulled on or climbed on a dress up shelf causing it to tip over and land on a one-year-old child’s hand. The shelf was positioned half on and half off a rug, causing it to be unstable. The child received professional medical treat for a hand injury.

During a Monitoring Visit conducted on May 23, 2023 ; It was determined based on observation that the following hazards were observed: - In Treetop, Rain Forest, Ocean, Busy Bugs and Jungle Classrooms- Toilet brushes and plungers were observed in the bathrooms. - Jungle Classroom- Garbage bags were stored in an open blue basket on top of the diaper changing table. - Rainforest Classroom- Hand sanitizer, white out, and adult scissors were located on the teacher's desk. Adult scissors were also observed in an unlocked drawer. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. During a LS POI Follow Up conducted on January 30, 2024 ; It was determined based on observation that the following hazards were observed: Tree House Classroom - A gallon container of bleach, spray paint, and a multiple cleaning solution were stored in an unlocked cabinet underneath the diaper changing table. - Sunscreen lotions and insect sting sprays were located in an unlocked drawer on the left top side of the diaper changing table. Polly Wogs Classroom - Staples and paper clips were located on the top of a red cabinet in front of the classroom. - Multiple diaper ointments and sunscreen lotions were observed in the bottom drawer underneath the diaper changing table. Rainforest - there were a variety of diaper ointment and sunscreen lotions in two cabinet drawers underneath the diaper changing table in the rainforest classroom. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a POI Follow Up conducted on March 27, 2024 ; It was determined based on observation that the following hazards were observed in the following classrooms: Safari Classroom - Two packs of Lysol wipes were observed on top of storage area. - A package of Lysol wipes was in a drawer of another plastic storage unit. - In the rear of the classroom, the storage closet door was unlocked and on the door were multiple containers of sunscreen lotions stored in a shoe organizer. - There was a staff purse hanging on a hook inside of the storage closet. - Sunscreen lotions and insect sting sprays were located in an unlocked drawer on the left top side of the diaper changing table. Polly Wogs Classroom - A plunger was observed in the rest room. Ocean Classroom - A stapler was observed in the cozy area. Busy Bugs Classroom -A plunger was stored in the restroom. Expeditions Classroom -A toilet brush was stored in the restroom. Jungle Classroom -coca butter lotion and a stapler were observed on a low shelf. Little Clouds Classroom - Two rolls of garbage bags were stored in an unlocked cabinet drawer. Rainforest Classroom - There was a can of sunscreen spray on top of the sink. - There was bag of liquid soap in an unlocked cabinet, with a warning label to keep out of reach of children. - There was a permanent marker and white out in an unlocked cabinet drawer.

During a Monitoring Visit conducted on May 23, 2023 ; It was determined based on observation that the lattice fencing on the left back corner had a gap at the bottom that measured at four inches wide. It was further determined that the fencing material on the left side measured between three and half inches to four inches between each wooden plank, which posed a potential entrapment hazard. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a POI Follow Up conducted on March 27, 2024 ; It was determined based on observation that wood panels were missing on the back fence panel, creating a gap measuring two feet and one inch by three feet. A large storage container was observed in front of the opening, however a potential entrapment hazard still existed, in that a gap measuring two feet and 10 inches by one foot was observed. It was further determined that a piece of the lattice panel was broken on top of a fence panel on the upper playground, which had rough and exposed edges. Exhibit "A"

During a Monitoring Visit conducted on May 23, 2023 ; It was determined based on observation that the playground was not in good repair: in that the following was observed: Older Toddler Playground - The red rubber resilient surface was splitting and lifting in several areas throughout the playground, posing a potential tripping hazard. - Over the drainage area, near the small climbing equipment, one wooden plank was missing, exposing a hole, measuring five inches long. Preschool /Pre-Playground -The green rubber resilient surface was splitting and lifting throughout the play area, posing a potential tripping hazard. -There were two worn areas underneath the swings, measuring over 12 inches long. - Near the blue helicopter, five rectangular pieces of the resilient surface material were not flushed and not secure, posing a potential tripping hazard.

During an Incident Investigation Closure conducted on July 3, 2023, it was determined based on investigative findings, that on May 3, 2023, a one-year-old child sustained an injury to their finger when a classroom door was closed on the child’s finger. Staff were unaware that the child was near the door after accompanying a staff member to get the lunch cart. The child required professional medical attention as a result of the incident.
