591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on April 15, 2025, at about 4:20 p.m. watchful oversight was not provided when staff persons did not intervene while two 3-year-old children were riding a single tricycle and fell, causing one child to hit their head on the hard, poured surface of the bike path. In addition, at approximately 4:35 p.m., the same child bumped heads with another child and began to cry. A parent notified staff that the child was crying. After pickup, professional medical attention was obtained, and the child was diagnosed with a concussion. 2. Rule 591-1-1-.03 (9) requires that Staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury. During an investigation, it was determined that on April 15, 2025, watchful oversight was not provided when a staff person did not intervene when two 3-year-old children were riding a single tricycle and fell resulting in one child sustaining a serious head injury. The two children collided with another tricycle. Both children on the single tricycle fell backward and one child hit their head on the hard, poured surface of the bike path. The child received professional medical treatment and was diagnosed with a concussion.

591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

591-1-1-.07(4) · Rule 591-1-1-.07(4) requires the Center to have a written plan which outlines how emergency medical services will be obtained, including place(s) the child will be taken for emergency care. When a medical emergency arises involving a child, the Center Staff shall seek prompt emergency medical treatment and provide any certified or licensed emergency medical persons with immediate access to the child.

During an investigation, it was determined that on September 17, 2024, at approximately 4:46 p.m., watchful oversight was not provided when a 3-year-old child reported arm pain while on the playground. Throughout the day, the child informed 3 staff members that their arm was hurting. Staff A declined the child’s request to use the seesaw and did not investigate further. Staff B offered cold water after the child stated a staff member had hurt their arm. Staff C checked the arm but observed no visible injury. Upon pickup, Staff C carried the child to their parent, who was informed of the earlier complaint. The child was taken for medical evaluation and diagnosed with Nursemaid’s Elbow. The center failed to provide adequate oversight, as staff were unaware of how the injury occurred and did not follow appropriate response procedures.

It was determined based on an investigation that on September 17, 2024, at an undetermined time center staff failed to provide watchful oversight when a three-year-old child sustained an injury to their left arm while in care at the center. Three staff members stated that the child reported that their arm was hurting. There were no visible signs of injury, and the child could not explain how the injury occurred. Staff members reported that they were unaware of when or how the child injured their arm. When the parent arrived to pick the child up, center staff informed the parent of the child’s complaint. Professional medical attention was required.

It was determined based on an investigation that on April 15, 2024, at approximately 5:11 pm a three-year-old child was left on the playground unsupervised for approximately three minutes. A parent observed the child to be alone on the playground and notified center staff. Center staff failed to provide watchful oversight when transitioning from the playground back into the classroom.
