591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on September 9, 2025, at approximately 2:57 p.m., a 2-year-old child was missing from Main Room B (preschool classroom) for approximately five minutes. The child was recovered by an unknown individual outside of the Center and returned to a staff member by an unrelated parent. The exact location and distance from the Center could not be determined. Additionally, in a separate incident on September 9, 2025, at approximately 2:00 p.m., a staff member left one 1-year-old child, two 2-year-old children, and four 3-year- old children unsupervised in Main Room B (preschool classroom) and departed for the day, while the only other staff member present in the building was in the kitchen. Approximately 13 minutes later, the remaining staff member left the kitchen, entered the classroom, and noticed one 1-year-old child and one 3-year-old child missing. The staff member recovered those missing children from the enclosed porch through another classroom. The remaining children were left napping and unsupervised in the classroom during that recovery. At the time of both incidents no other staff were at the Center.

591-1-1-.31(11) · Rule 591-1-1-.31(11) requires that the Center have qualified and sufficient direct-care, clerical, housekeeping, maintenance and other support staff to ensure full compliance with these rules without neglecting the supervision of the children.
During an investigation, it was determined that on September 9, 2025, one staff person was responsible for a group of seven children consisting of one 1-year-old child, two 2-year-old children, and four 3-year-old children. The staff person was the only staff present at the Center from approximately 2 p.m. There were not any support staff on site to assist with either the care of the children or other operations of the program, which ultimately lead to two incidences of unsupervised children, which occurred less than an hour apart.

591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that parents must be notified of a child's incidents, illnesses or injuries as follows: Immediately notify Parent(s) and obtain specific instructions until child can be picked up or returned to group. When professional medical attention is required, or when child experiences symptoms of moderate discomfort such as elevated temperature, vomiting or diarrhea., or when child is involved in an incident that puts their health and/or safety at risk (e.g., missing from program, left on vehicle, escaped from building/playground, etc.) Notify Parent(s) by the end of the day. During an investigation, it was determined that on September 9, 2025, staff failed to immediately notify the parents of a 2-year-old child who left the building and was missing from the Center for approximately 5 minutes. The incident took place at 2:57 p.m. and the parents were not notified until 4:30 p.m. It was further determined that on the same date, Center staff failed to notify the parents of one 1-year-old child and one 4-year- old child when they were missing and later located on the outside porch.

The investigation closure of October 21, 2025, determined that on September 9, 2025, adequate supervision was not provided when a 2-year- old child exited the building for an undetermined amount of time, and when a 1-year-old child and a 3-year-old child exited the classroom and were located on the outside, enclosed porch. The staff member present was unaware that the children had left the building or classroom. An office conference was conducted on November 25, 2025, to discuss rule violation(s) and improvement action. Each rule violation for which Georgia Department of Early Care and Learning (DECAL) is taking this action is described in Exhibit "A" which is attached to this letter. Based on the license holder’s noncompliance with the rules, the license holder is hereby notified of the intent of DECAL to impose an enforcement fine in the amount of $299.00. DECAL’s legal authority for imposition of an enforcement fine is found in O.C.G.A. Sections 20-1A-1 et seq. and the DECAL Rules for Child Care Learning Centers, Chapter 591-1-1 of the Official Compilation of the Rules and Regulations of the State of Georgia. The license holder is also advised that the failure to correct and maintain compliance with these rules may result in further adverse action which could include the revocation of the license to operate Morgan’s Early Care Connection could also include the imposition of daily fines for each day the violations continue. Licensure staff will conduct a follow-up visit to determine compliance with the rules and regulations. The license holder has the right to submit a written statement detailing why DECAL should not take this adverse action. If the license holder submits a written statement, the statement will be placed in the facility’s state file. The license holder also has the right to request a hearing before an Administrative Law Judge at the Office of State Administrative Hearings to appeal this adverse action.
