591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that when a child requires a modified diet for medical reasons, a written statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child’s Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.

During an investigation, it was determined that on November 24, 2025, between 2:15 p.m. and 2:30 p.m., center staff failed to follow the modified diet for a 3-year-old child. During snack time, the child was served a peanut butter and jelly sandwich, which contains an item to which the child is allergic. The child briefly played with the sandwich, and after the staff member encouraged the child to eat it, the child consumed a portion of the sandwich. The staff member then remembered that the child could not eat peanuts due to the child’s allergy and removed the sandwich. At approximately 3:25 p.m., the child’s parent arrived for pick up and was informed that the child consumed peanut butter. The child later exhibited signs of an allergic reaction and received professional medical attention.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).

During an investigation, it was determined that center staff failed to report to the Department within 24 hours or the next work day that on November 24, 2025, a 3-year-old child received professional medical attention after they were served and allowed to consume a peanut butter sandwich that contained an ingredient to which the child was allergic. The center was informed on November 24, 2025 that the child received medical attention, but the center did not notify the Department of the incident.
