591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined based on an investigation that on March 14, 2025, at approximately 4:30 p.m., the center staff did not provide watchful oversight when a 3-year-old child sustained a head injury while washing their hands in Classroom 6L-2R. Two 3-year-old children were in the restroom together washing their hands when they hit and pushed each other. Staff were not positioned to see the children and to respond promptly to their actions as required by the Department. One child pushed the other who fell and hit their head on the toilet. Professional medical attention was required.

It was determined based on investigative findings that on December 19, 2024, at approximately 4:00 p.m. a 4- year-old child was left alone inside the classroom for approximately five minutes after the rest of the class was taken outside to the playground. Staff in room 6L-2R failed to provide watchful oversight when a child was left standing near a table in the classroom. The child was discovered by another staff member and taken to management.

It was determined based on an investigation that on April 2, 2025, at approximately 9:00 a.m., watchful oversight was not provided for a 3-year-old child, when a staff member did not observe a 3-year-old child to be missing from the classroom for approximately two minutes, when the child opened the classroom door, ran down the hallway, exited the building into the parking lot. It was further determined based on an investigation that watchful oversight was not provided for 3-year-old and 4-year-old children, when a staff member briefly walked out of the classroom leaving 13 children unsupervised for approximately twenty seconds.

During an investigation, it was determined that on January 31, 2025, at approximately 3:24 p.m., a three-year-old child sustained a scratch and two red marks on their left arm when a staff member grabbed the child by the arm. According to video footage, the staff member grabbed the child by the arm as a form of discipline while in the classroom. DECAL determined that the staff member engaged in physically grabbing the children by their arms as a form of discipline practiced towards the children at the facility. No professional medical attention was obtained.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined through observation of video footage that on April 28, 2022, center staff picked up a one-year-old child by the hand, lifted them over a wooden structure and placed them down on the other side of the wooden structure. The child sustained a fracture near their right elbow as a result of the incident.

It was determined, based on an incident investigation, that on October 14, 2021 a child in the three-year-old class was inappropriately disciplined by a staff member. Video footage, provided during the investigation, showed an altercation to occur between a three-year-old child and center staff. The staff person was observed to have their hand near the child’s neck area and attempting to adjust the child’s mask. The staff person was observed to pick up a three-year-old child abruptly and roughly by their right arm, lifting the child off their feet two times, and relocate the child to another location in the classroom. The physical altercation was observed to continue in the new location. Based on the review of the documentation, the child sustained a red mark to their neck.
