591-1-1-.03(8) · Rule 591-1-1-.03(8) requires that personnel shall provide individual attention to each child. Examples include, but are not limited to: responding promptly to the child's distress signals and need for comfort; playing with and talking to the children; and providing and assisting the child with personal care in a manner appropriate to the child's age level, i.e., providing the child privacy in dressing, diapering and toileting functions as the developmental age of the child dictates.
During an investigation, it was determined that on April 24, 2025, at approximately 9:56 a.m., a 5-year-old child sustained a serious shoulder injury during a physical altercation with another child while in the classroom. One staff member was present with nine 5-year-old and 6-year-old children in the classroom at the time of the incident. Video footage showed the staff member sitting at a table, looking down at a personal phone device, while two children sat nearby, and seven others stood at the desk holding papers. An altercation ensued between two children. One child was pushed down by another child sustaining an injury. The staff member did not get up to provide individual attention to the injured although the staff member indicated that the child stated that their shoulder hurt.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on April 24, 2025, at 9:56 a.m., watchful oversight was not provided to a 5-year-old child, when the child was pushed down by another student, sustained an injury, and staff were unaware of what happened. The investigation determined that the staff member was on her personal cell phone at the time of the incident. Professional medical attention was obtained, and the child was diagnosed with a serious shoulder injury.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During an investigation, it was determined that on October 1, 2024, a staff person handled a two-year-old child roughly when they vigorously and continuously struck the child’s back with an open hand for approximately 12 minutes, resulting in a large bruise. They began to pat the child’s back, between the shoulder blades, but as they continued, they began to strike the child with an open hand in a rough manner as the child cried. That evening a large bruise was observed on the child’s back, between their shoulder blades.

591-1-1-.29(1) · Rule 591-1-1-.29(1) requires that within twenty-four (24) hours or the next work day, the Director or designated person-in-charge shall report or cause to be reported any suspected incidents of child abuse, neglect or deprivation to the local County Division of Family and Children Services in accordance with state law and to the Department, notifying that such a report was made.
During an investigation, it was determined that on October 1, 2024, an instance of suspected child abuse was not reported to Division of Family and Children Services (DFCS) within 24 hours as required. On October 3, 2024, an instance of suspected child abuse was reported to a member of management. On October 8, 2024, management reviewed the video footage and observed a staff member handling a child in a rough manner and made a report to DFCS.
