591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on October 2, 2025, a 1-year-old child sustained an injury to the back of the head after losing their balance on a tunnel and hitting their head on a toy truck. The child was standing on the edge of the tunnel, lost balance and fell back. There were three staff members caring for thirteen 1-year-old children and eleven 2-year-old children when the incident occurred. The staff members were unaware of how the injury occurred as they were not positioned in a manner they were able to observe and respond to the children’s actions. The injury required professional medical attention.

591-1-1-.12(2) · Rule 591-1-1-.12(2) requires that equipment and furniture shall be free from hazardous conditions such as, but not limited to, sharp rough edges or toxic paint and shall be kept clean.

During an investigation, it was determined that on February 2, 2022, a one-year-old child sustained a cut to their finger while on the playground on a broken toy or a storage equipment’s top that was cracked. Staff attended to the child’s injury but were unsure if the broken toy or cracked top caused the injury.
