591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on August 28, 2024 ; It was determined that on July 15, 2024, children were not adequately supervised when a four-year-old child exited the center and traveled .2 miles away from the center. The child exited the building and the enclosed campus through two gates, one of which had a locking mechanism. The child was spotted, running in the street, by a resident of the facility who recognized the child. A non child care staff person drove the facility¶s van and found the child with the resident as they were walking back to the facility. The child was not supervised by center staff for approximately 10 minutes. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on November 19, 2024 ; It was determined that on September 30, 2024, watchful oversight was not provided when a one-year-old child sustained a bump on the head. The child¶s parent arrived for pick up at approximately 1:00 p.m. After retrieving the child, the parent took the child across the hall, into an empty classroom. Approximately four and a half minutes later, the child¶s parent exited the classroom and reported a bump on the child¶s head to management. Staff persons were not aware of how the child sustained the bump on the forehead. The child did not require professional medical treatment. Exhibit "A"

The child exited the building and the enclosed campus through two gates, one of which had a locking mechanism. The child was spotted, running in the street, by a resident of the facility who recognized the child.
