    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Complaint Closure conducted on March 5, 2025 ; It was determined based on staff interviews,staff written statements and review of the recorded video, that a 2-year-old child was observed to have been left on the infants/toddlers playground for 12 minutes without an adult present providing watchful oversight supervision. The staff admitted the 2-year-old classroom was brought inside the center at 5:03 PM, and did not realize that a 2-year-old child had been left on the playground until a parent informed them at 5:15 PM. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an Incident Investigation Closure conducted on July 21, 2025 ; It was determined based on an investigation that on May 6, 2025, at approximately 4:05 p.m., three 2-year-old children exited the playground unsupervised and entered the center¶s parking lot, where vehicles were present. Staff were unaware the children had left the area. The children were observed running back toward the playground gate as the center¶s security officer approached. It was determined that staff were not positioned to see or hear the children at all times, which allowed them to exit the playground without staff knowledge. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Staff were unaware the children had left the area. One staff member was interacting with the children, and another was seated in a grassy area under the shade. The children were observed on video leaving the playground area through a gate. Two of the 2-year-old children entered the parking lot where vehicles were present. The children were running back toward the playground gate as the center’s security officer approached. It was determined that staff were not positioned to see or hear the children at all times, which allowed them to exit the playground without staff knowledge. .

    It was determined based on an investigation that on February 6, 2025, at approximately 5:03 p.m. a 2-year-old child was left alone and unsupervised on the infant/toddler playground for approximately 12 minutes. When staff transitioned from the playground to the classroom the child was left outside. Staff were unaware that the child was outside until notified by a parent at approximately 5:15 p.m. Staff failed to provide proper supervision when they did not ensure that all children were accounted for prior to transitioning back into the classroom.
