591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in or allow children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on May 19, 2025, at 10:50 a.m., a 2-year-old child sustained a tooth and lip injury while in classroom. There were two teachers present in the classroom with 11 2-year-old children at the time of the incident. In preparation for lunch, Staff member A was positioned on the far-left side of the classroom, assisting the children on the carpet with cleaning up an activity and staff member B was in the restroom changing a child's diaper. The 2-year-old child was positioned on the far-right side of the classroom at a toy shelf, the child was jumping and tapping their feet near the toy shelf. Staff member A instructed the child to clean-up; however, the child continued to jump on one foot. According to staff statements, while cleaning the classroom, staff member A turned their back towards the child on their left side. Staff member A reported hearing the child crying and in their peripheral vision, observed the child lose their balance, grab the toy shelf, and fall onto the carpet. Staff member B heard a loud bang and the child crying. The child received a cut on their bottom lip, caused by their upper two front teeth. The center staff allowed a child to engage in an activity that was detrimental to the child’s health and well-being and failed to immediately physically intervene to redirect the child’s actions. The 2-year-old child required professional medical attention as a result of the incident.
