591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During an investigation, it was determined that on April 14, 2025, a staff member inappropriately disciplined a 4- year-old child when the staff member grabbed the child by the face and neck to speak with them, resulting in scratches on the child’s neck. During the transition from lunch to nap time, the 4-year-old child was running around the classroom, and a staff member attempted to redirect the child’s behavior verbally. The child continued to run, and the staff member grabbed the child by the face and neck, leading the child to their cot. The action taken by the staff member resulted in large scratches on the child’s neck.

During an Incident Investigation Closure conducted on April 30, 2025, it was determined that on August 29, 2024, staff were unaware a two-year-old child climbed on the retaining wall on the playground, fell, and sustained an injury to the left arm. One staff member was lining up children to go inside and the other two staff members were on the other side of the playground, gathering children to go inside. After the fall, the child walked to a staff member crying and made them aware they had fallen and were hurt. The injury required professional medical attention.

Children were observed playing in areas of the activity room where there were no staff members properly positioned nearby to respond and actively monitor their actions.

During an investigation, it was determined that on June 25, 2024, a four-year-old child sustained burns to both feet, when a staff member allowed him to remove his shoes while outside, and the child walked on a hot play structure. The staff member was unaware of the seriousness of the injury and did not see it occur. The child let the staff member know he was hurt and in pain. Professional medical attention was required.

During an investigation, it was determined that on June 25, 2024, a four-year-old child sustained burns to both feet while outside on the playground area. The child removed his shoes, per staff approval, and burned his feet on a piece of playground equipment. The incident occurred at 12:30 PM, but the mother was not notified until pick-up at 4:18 PM. Professional medical attention was required.

During an investigation, it was determined that on June 25, 2024, a four-year-old child sustained burns to both feet while outside on the playground area. At 12:30 PM, the child removed his shoes, per staff approval, and burned his feet on a piece of playground equipment. The child was uncomfortable and not able to walk on his feet for the rest of the afternoon. The child also had a toileting accident due to the injuries to their feet. The child was in pain and uncomfortable until the parent picked them up at 4:18 PM. Professional medical attention was required.

During an investigation, it was determined that watchful oversight was not provided on April 27, 2023, when a two- year-old child was struck in the face when a piece of classroom equipment fell on the child. As staff prepared to serve children lunch, the two-year-old child began swinging on a wooden wardrobe cart in the dramatic play center. Another child walked over and began swinging with the two-year-old child. The wardrobe cart fell over, landing on the face of the two-year-old child. The staff in the classroom were engaged and speaking with each other and were not aware that the children were swinging on the wardrobe cart. After the wardrobe cart fell on the child, the teacher immediately ran to the child and administered first aid. The child sustained a head and nose injury that required professional medical attention. 3. A. Such supervision must include, but not be limited to, indoor and outdoor activities, meal times, nap time, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Studentsin-Training. One of the five staff members was seated on the playground bench between the playscape and the building at the time of the incident and was unaware of the child’s injury until one of the teachers witnessed the child lying on the ground. It was further determined that the remaining staff were on the other side of the play structure where they could not see the incident occur. 3. B.
