    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in or allow children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on March 18, 2024, children engaged in rough play activities in the classroom, resulting in a three-year-old child sustaining an injury to their chin due to the rough play. The three-year- old child and some additional children were jumping off a chair. The staff told the children multiple times to stop, however, the children continued jumping off of the chair. The staff did not physically intervene to stop the children, resulting in the three-year-old child falling and injuring their chin. The child received professional medical attention and due to a chin injury.

    591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).

    During an investigation, it was determined that on March 18, 2024, a three-year-old child sustained a laceration to the chin while in care at the center. Center staff failed to report to the Department within 24 hours or the next workday as required after becoming made aware that the three-year-old child having obtained professional medical attention.

    591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

    During an investigation, it was determined that on March 18, 2024, a three-year-old child’s parent was not immediately notified of an incident that required professional medical attention. According to staff statements, the center management attempted to contact the child's parents and left a voice message. The center staff did not contact the child's emergency contacts. Based on evidence, it was determined that the child’s parent did not receive a call or a voicemail from the center. The center failed to immediately notify the child’s parent of the incident involving the child’s health and safety that required medical attention.
