    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During an investigation, it was determined that on October 28, 2025, inappropriate discipline was used when a 2- year-old child was roughly handled by a staff member. While the staff member was sitting on the classroom carpet, the 2-year-old child slapped the staff member in the face. The staff member immediately grabbed the child by both arms and slammed the child onto the carpet, causing the child’s head to hit the floor. Shortly thereafter, the parent arrived for pick up and noticed that the child was lethargic. The child was taken for professional medical attention and was treated for a minor head injury.

    591-1-1-.31(13) · Rule 591-1-1-.31(13) requires that Center Staff shall not commit any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center. Center staff shall comply with all applicable laws and regulations.

    During an investigation, it was determined that on October 28, 2025, a 2-year-old child was roughly handled by a staff member. While the staff member was sitting on the classroom carpet, the 2-year-old child slapped the staff member in the face. The staff member immediately grabbed the child by both arms and slammed the child onto the carpet, causing the child’s head to hit the floor. The child was taken for professional medical attention and was treated for a minor head injury. The staff member was arrested on November 12, 2025, and charged with cruelty to children, simple battery, and aggravated battery in relation to the incident.

    591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge to report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).

    During an investigation, it was determined that the Center failed to report to the Department within 24 hours or the next work day that on October 28, 2025, a 2-year-old child received professional medical attention for a minor head injury. Center Staff grabbed the 2-year-old child by both forearms and forced the child to the floor, causing the child to hit their head on the floor. Center management was notified on October 29, 2025 that the child had received medical care, but did not report the incident to the Department until November 2, 2025.
