591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on June 3, 2025, a staff member was caring for ten children during nap time. The video showed that the staff member went out of the center’s front door and left it partially open. The 3-year-old child left the classroom and went out of the open front door. The staff member stated she was unaware the child left the room, then the building, until a passerby knocked on the center’s door to inform them there was a child standing by the road. The staff then looked outside and saw the 3-year-old child from her classroom, outside by the road. The child walked approximately 94 feet from their cot to the road where they were found by a passerby. Professional medical attention was not required.

591-1-1-.31(13) · Rule 591-1-1-.31(13) requires that center Staff shall not commit any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center. Center staff shall comply with all applicable laws and regulations.

During an investigation, it was determined that on June 3, 2025, a staff member left ten children unsupervised in a classroom while they went out of the front door of the center. The 3-year-old child walked out of the building and was found by a passerby approximately 94 feet from the center by a road. The staff member was arrested on June 17, 2025, and charged with reckless conduct.
