591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During a Complaint Closure conducted on September 29, 2022 ; It was determined based on investigation findings that on September 12, 2022 a three-year-old child was found alone in the classroom's restroom. The lights were off and the child had feces smeared on several parts of their body. The teacher was unaware that the child was in the bathroom with the lights off. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Investigation by Phone conducted on February 16, 2022 ; It was determined based on an investigative findings that on February 10, 2022, center staff failed to provide adequate supervision in that staff were unaware of how a nine-month-old infant sustained scratches to the face and a bruise on the hand. The infant received medical attention as a precaution. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

It was further reported that the staff member turned around and forgot that the child was left in the highchair. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an Incident Investigation by Phone, conducted on April 8, 2022, it was determined based on interviews and statements from staff and parents that on April 7, 2022, a center staff did not use a high chair in accordance with the manufacturer’s instructions, recommendations, and intended use, when a nine-month-old infant fell out of the high chair onto the floor when a staff member took the tray off and turned around to clean it. The child was not strapped in as required. The child received medical attention as a precaution.
