    591-1-1-.10(5) · Rule 591-1-1-.10(5) requires infants and children shall not be left unattended while being diapered or having their clothes changed on the diaper changing surface.

    During an investigation, it was determined that on December 2, 2022 a staff member left a two-year-old child unattended on a diaper changing table to attend to an injured child. Video footage revealed that the staff member was changing a child’s diaper when a bookshelf fell on top of another child. The staff member left the child on the changing table to tend to the child on the floor.

    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires Staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on December 2, 2022 a staff member dropped a two-year-old child while placing the child down on the floor from the diapering table. The center staff failed to secure a two-year-old on the floor and as a result, the two-year-old was let go by the staff member before the child’s feet were on the floor. The child fell onto the tiled floor. It was determined that center staff handled a child in a manner that caused injury to the two-year-old child when the child sustained a leg injury that required professional medical attention.

    591-1-1-.12(4) · Rule 591-1-1-.12(4) requires equipment and furniture shall be secured if it is of a weight or mass that could cause injury from tipping, falling, or being pulled or pushed over. Potentially unstable equipment and furniture that might injure a child if not secured include, but are not limited to, televisions, chests of drawers, bookcases, shelving, cabinets and fish tanks. Examples of items not required to be secured include, but are not limited to, child-sized tables and chairs, rocking chairs, and cribs.

    During an investigation, it was determined that on December 2, 2022 the center failed to secure bookshelf equipment when two children, including the two-year-old child, knocked over a two-tier shelf that was used to store books. The shelf landed on the leg of the two-year-old child causing a broken femur. A staff member picked the bookshelf up off the child. The bookshelf classroom furniture was not sturdy or secured enough to prevent tipping, falling, or being pushed over and causing injury.

    During an investigation, it was determined that on December 2, 2022 a staff member was left alone to supervise ten, two-year-old children and one, five-year-old child. Based on the number and ages of the children, the required ratio was 2:11. The staff: child ratio was inadequate on this date.

    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on December 2, 2022 a staff member failed to provide adequate supervision when a two-year-old child grabbed a shelf and the shelf fell on top of the child. The staff person was changing a child’s diaper when the incident occurred. There were two children sitting on top of the shelf when the child walked over, and the other two children jumped off making the shelf fall over onto the child. The two-year- old child sustained a broken femur as a result of the fall. Additionally, it was determined that the teach failed to provide adequate supervision to children when they left the class unattended on several occasions.
