    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on December 8, 2025, at approximately 9:45 a.m., center staff failed to properly intervene and deter a 3-year-old child from climbing on a shelf that was not securely anchored, resulting in the shelf falling on the child. During center time, a staff member verbally directed the child to stop climbing on the shelf and then turned to assist another child. The 3-year-old child climbed onto the shelf again and the shelf fell over. The child landed on their back and the shelf landed on top of them. The child received professional medical treatment and was diagnosed with a closed head injury and a traumatic hematoma of the forehead.
