591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During a Complaint Closure conducted on August 14, 2025 ; It was determined based on an investigation that on July 10, 2025, adequate supervision was not provided when a 2-year-old child repeatedly bit a 1-year-old child while in the indoor playground. Walls and blind spots existed on the play structure and staff members were not positioned to maximize their ability to see and hear the children at all times. Exhibit "A"

During a Complaint Closure conducted on October 7, 2024 ; It was determined based on an investigation that on February 15, 2024, at approximately 4:45 p.m., a non-verbal 4-year-old child left the classroom unsupervised and was found 200 feet away from the facility. The child was unsupervised for about ten minutes. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

It was determined based on an investigation that on February 15, 2024, at approximately 4:45 p.m., a non-verbal four-year-old child left the classroom unnoticed and was missing and unsupervised for approximately ten minutes. Staff stated that the classroom door was propped open. Staff were unaware that the child had left the classroom until a parent reported a child wandering in the parking lot. The child walked into a nearby senior living center which was approximately 200 feet away. Staff from the center found the child and notified the center.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge to report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
It was determined based on an investigation that on February 15, 2024, at approximately 4:45 p.m., a child left the classroom unnoticed after staff propped the door open. The child walked to a nearby senior living center which was approximately 200 feet away and a staff member from the facility reported that a child was in their building. Center staff retrieved the child and returned them to the center. Center staff failed to report the incident to the Department within the required 24 hours.
