    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on October 5, 2023, a two-year-old child was left on the playground and unsupervised for approximately 92 minutes. On October 5, 2023, at11:45 a.m., there were three staff members present with 21 two-year-old children on the playground. According to staff interviews, while on the playground a staff person went to take their lunch break, leaving two staff members with 21 two-year-old children on the playground. When the staff transitioned from the playground to the classroom, staff did not conduct a name to face check upon transitioning the children inside the classroom. There were 20 children transitioned into the classroom from the playground. According to staff statements, a bystander observed the two-year-old child on the playground alone and unsupervised. The bystander notified the administrative staff of the child’s whereabouts. The two-year- old child was left on the playground, unsupervised for 92 minutes. According to accuweather.com, the outdoor temperature was between 80 degrees Fahrenheit and 60 degrees Fahrenheit on October 5, 2023. Staff were unaware that the two-year-old child was missing from the classroom.
