591-1-1-.11(1) · Rule 591-1-1-.11(1) requires that disciplinary actions used to correct a child's behavior, guidance techniques $499.00 and any activities in which the children participate or observe at the Center shall not be detrimental to the physical or mental health of any child.

During an investigation, it was determined that on December 27, 2021, a three-year-old child sustained a fractured pinky finger when the child was underneath a table, and a staff member turned the table on its side which caused the table to slip and fall onto the child’s hand. At approximately 3:00 PM a staff member supervised a group of nine three-year-old children. Two three-year-old children were running around the classroom and went underneath a table. The staff member verbally redirected the children to come out from underneath the table, however the children did not comply. The staff member attempted to remove the children from underneath the table by flipping the table to its side which caused the table to slip from the staff member’s hand and fall onto the child’s hand. Professional medical attention was obtained. The child was diagnosed with a fractured pinky finger.
