Child care personnel inappropriately interacted with children in care in a manner that was aggressive, demeaning or intimidating in nature. A staff member was determined to have kissed a child on the back of the head causing the child to be uncomfortable with the incident. The staff member no longer works at the facility. 8.2 Child Safety A. Acts or omissions that meet the definition of child abuse or neglect provided in Chapter 39, F.S. or Chapter 827, F.S., constitute a violation of the standards is section 402.301- .319, F.S., and will support imposition of a sanction, as provided in Section 402.310, F.S. B. Failure to perform the duties of a mandatory reporter pursuant to Section 39.201, F.S., constitutes a violation of the standards in Section 402.301-.319, F.S. C. Child care personnel must appropriately interact with children to foster a healthy, safe environment that will encourage the childs physical, intellectual, motor, and social development. Interactions with children that are aggressive, demeaning or intimidating in nature are strictly prohibited. 2.1 Health and Safety DCF health and safety requirements are outlined below by provider type: A. Licensed child care facilities must comply with Rules 65C-22.001, 65C-22.007, 65C22.008, and 65C-22.010, F.A.C. B. License-exempt child care facilities must comply with Rule 65C-22.001(6), F.A.C., Child Care Facility Handbook (October 2021), and Rule 65C-22.010(1)(e)1., F.A.C., CF-FSP Form 5316, Child Care Facility Standards Classification Summary (October 2021) standards 2 32, 3545, 47, and sub-standards 1.4, 33.433.5, 33.7-33.10, 46.1-46.4, and 46.7. C. Licensed school-age child care facilities must comply with Rules 65C-22.008 and 22.010, F.A.C. D. License-exempt school-age child care facilities must comply with Rule 65C-22.008(5), F.A.C., School-Age Child Care Facility Handbook (October 2021), and Rule 65C22.010(1)(e)1., F.A.C., CF-FSP Form 5427, School-Age Child Care Facility Standards Classification Summary (October 2021) standards 2-27, 3038, 40, and sub-standards 1.4, 28.2, 28.428.9, 39.139.4, and 39.7

12-02 · Facility Environment
The ceiling in 2 of the activity classrooms revealed missing ceiling tiles. Several of the ceiling tiles appeared to have water stains. During the inspection, technical assistance was provided. 11 Indoor Equipment Equipment, materials, furnishings, and play areas should be sturdy, safe, and in good repair. Provider should monitor the Consumer Product Safety Commission (CPSC)recommendations for use of equipment. Walls, ceilings, floors, furnishings, equipment, toys, and other surfaces should be suitable to the location and the users. They should be maintained in good repair, free from visible soil and clean. Equipment and furnishings must be arranged to allow direct supervision of children by child care personnel from all areas within a room/play area. Bookshelves, televisions, and other heavy furnishings must be stable and secured as to not pose a threat of falling over. In efforts to prevent children from climbing to dangerous heights or enabling them to reach hazardous items, chairs and other furnishings must be placed away from cabinets and shelves. The program should make accommodations to the program environment and schedule so that children with special needs may participate

32-03 · Outdoor Equipment
The play equipment was not maintained in a safe or sanitary condition for the children to use in that sharp edges on the steps were observed on the playground climber. During the inspection, technical assistance was provided. 3.12 Outdoor Equipment A. A child care facility must provide and maintain enough usable equipment suitable to each childs age and development and of a quantity for each to be involved in activities. B. All playground equipment must be securely anchored, unless portable or stationary by design, in good repair, maintained in safe and sanitary condition, and placed to ensure safe use by the children. Maintenance must include inspections conducted every month of all supports above and below the ground and of all connectors and moving parts. Documentation of maintenance inspections must be maintained for 12 months. C. All equipment, fences, and objects on the facilitys premises shall be free from sharp, broken and jagged edges, and properly placed to prevent overcrowding or safety hazards in any one area. D. Permanent or stationary playground equipment must have a fall/use zone that extends a minimum of 6 feet in all directions from the perimeter of the equipment. All types of ground cover must be maintained to provide resilience and reduce the incidence of injuries to children in the event of falls
